The aim of this article is to review the legality of the obligation to wear respiratory protective equipment, which was introduced in connection with the coronavirus pandemic in the Czech and Polish Republics. In both countries, the obligation itself is laid down in by-laws, the legal basis of which is uncertain at best.
The article firstly outlines the constitutional dimension of the issue, then deals with the regulation at statutory level and finally addresses the question compliance of the by-laws with the abovementioned levels, while taking into account the opinion of the professional public, as well as case law, if available.
