International legal aspects of the concurrence of designation rights and unfair competition in current concept

Abstract

The free movement of goods and gradual harmonization of national law facilitate cross-border transactions, thus contribute to the development of international trade and also the electronization of services and use of the Internet. In the context of cross-border online transactions, the question arises in which Member State the injured trader might claim damage of the infringements of designation right and European Union trade mark and as well from unfair competition, including a possible extent of the damage.
