Contracts about International Transport with the Focus on the Convention on the Contract for the International Carriage of Goods by Road and its Incorporation into the Law of the Czech Republic (Jurisdiction of the Courts of Law of the CR)

Abstract

In international transport there is (apart from the purchase contract) extended internationally unified legislation contained in the international conventions and agreements. These conventions and agreements contain detailed legislation particularly referring to transport documents and the responsibility of the carrier.

These issues are among the most important aspects of international transport. The provisions of these international conventions, which must be strictly observed, very often provide protection for the user of the transport who is in this respect the weaker contract party.

Also, most of the provisions of the Convention on the Contract for the International Carriage of Goods by Road (CMR) are mandatory in nature. The interpretation of the Convention is conducted by the national courts of justice of the individual states of the Convention within their decisionmaking practice.

This can give rise to problems caused by various interpretations. This paper therefore contains some selected cases which were dealt with by the courts of the Czech Republic.
