Abstract
Although the number and scope of Czech valid and effective legal regulations may seem considerable, there are still situations where a certain legal issue is not regulated in any legal regulation. In such a case, a fundamental question may arise as to how to assess a legal problem and how to resolve such a dispute.
The answers to the theoretical possibilities of the solution, how the Czech courts approach the question asked and what is the related case law of the Constitutional Court is contained in this text.
