Designation of an international forum in the event of concurrence of infringements of designation rights and unfair competition

Abstract
The paper deals with the question, in the courts of which Member State the injured entrepreneur may assert claims arising from infringement of the Company name, the European Union trade mark, and as well as under the unfair competition and whether, in such designated court, the injured claimant may claim damages the whole of the damage caused throughout the other states, or territorially limited, and last but not least, the paper deals with the existence of a possible concurrence of infringement of designation rights and unfair competition.
