Abstract
The author deals with the essentials of the decisions of courts in criminal matters, focusing his attention on the giving their reasons. He reminds the importance of the reasoning of the decision, which is perceived by both doctrine and application practice as part of the right to a fair trial and the rights of the defence.
It also mentions the relevant case law of the European Court of Human Rights. Finally, it presents the existing Czech legislation and some problems worthy of a solution in the work on the new Criminal Procedure Code.
