Preliminary proceedings in the recodified legislation proposal

Abstract

The author discusses in this contribution the state of work on the future Criminal Procedure Code and the most important changes in the proposed future legal regulation of preliminary proceedings. In particular it presents the changes in the individual forms of preliminary proceedings, in the initiation of criminal prosecution, in providing and carrying out the evidence, as well as in the extension of the opportunistic elements and the possibilities of prosecution suspension by the public prosecutor; it remarks also other possible considerations of further conceptual changes in this area.
