What Influences the Constitutional Court and its Judges?

Abstract

The publication examines legal and non-legal factors that influence the decision-making of the Constitutional Court of the Czech Republic. It focuses mainly on ho the external political and social environment foremes the preconditions of the courts decision-making, how this decision-making reflects the different attitudes and approaches of individual courts and what effect the composition of court chambers has on it.

Using empirical methods, the author shows that the differences between individual judges are significantly manifested in the activities of the court, and especially the differences between the activist and self-restrained approach of judges.
