Abstract

The author states that the principle of judicial self-restraint is interpreted inconsistently, both in the professional literature and judicial practice. This is the case not only in the Czech Republic, but abroad.

The author himself defines the principle of judicial self-restraint as a requirement that courts act and decide only in matters falling within the jurisdiction and that they refrain from acting and deciding in matters falling within the competence of legislative and executive bodies.
