On government, governance and administration

Abstract

The paper deals with the nature of the competence of the government as the highest body of executive power. It distinguishes the governance from the performance of state administration as an activity (in the functional sense) of the government (in the institutional sense).

The attention to the development of the term "governance" is also paid. Administrative activity is under control within the administrative judiciary.

Governance activity is only under political control of Parliament and, in certain aspects, under control of the Constitutional Court. The governments role in declaring a state of emergency and issuing crisis measures in connection with the covid-19 pandemic has given new impulse to the discussion on the relationship between the governance and the administration.
