The EU measures coordinating the entry conditions into the Schengen area in response to COVID-19

Abstract

This article describes and analyses the measures taken at the EU level to coordinate the entry conditions into the Schengen area in response to COVID-19, focusing on Council Recommendation (EU) 2020/912. It assesses how the Czech Republic has implemented those measures.

It critically evaluates the EU coordinating efforts in the light of the existing EU legal rules, especially the Schengen Borders Code. Lastly, it argues that it is essential to revise the current EU legal framework to make it possible to adopt binding EU measures in those areas in which there has only been non-binding coordination.
