Posting of Workers Payments in the Light of Directive on Transparent and Predictable Working Conditions

Abstract

The Posted Workers Directive represents a compromise on how to negotiate the tension between freedom and protection in an employment relationship with employees temporarily relocated to another Member State. The Directive on Transparent and Predictable Working Conditions should ensure that relocated employees are or will be aware of wage conditions levied upon them during the relocation period.

However, Czech law does not conceive the concept of associated employers and courts are reluctant to consider wage conditions of other employers as proved by cited case law.
