Podlipny et al. presented the European perspective of children patient rights constituted on the tradition of Greek-Roman legal tradition. In the 20th century, it was enlarged with an emphasis on each individual's human rights.
In the Czech legal system, the fundamental role in legal consideration has the CHARTER OF FUNDAMENTAL RIGHTS AND FREEDOMS as a part of the constitutional order of the Czech Republic. It represents the constitutional act No. 2/1993 Coll. as amended by constitutional act No. 162/1998 Coll.
Under the §15 et seq. of the Czech Civil Code every person has innate rights, a legal entity from their birth until their death. Under agreement §30 of the mentioned Act, an individual acquires full legal capacity upon reaching full legal age (majority).
