Abstract
We fundamentally reject the view that the mere negative perceptions that patients report in connection with lege artis given general anesthesia fully justify the claim for compensation. The stated subjective difficulties are very difficult to objectify and cannot be demonstrably and irrefutably linked to the provided anesthesia, and therefore, in our opinion, they do not justify their compensation.
The constant emphasis on patients' rights to compensation is aimed at reducing the radical nature of surgical procedures and activities leading to alibis, which will not benefit patients or doctors. The constant threat of sanctions increases the stress of attending physicians, their extinction, and, as a result, fears of increased administration.
