An Employee After All is Not Liable for Damage Caused to a Third Person in Discharge of his Labour Obligations (as Hopefully Opposed to Board Members and Other "Assistants")

Abstract

The paper analysis the conclusions of two recent decisions of the Supreme Court concerning the question of a (lack of) parallel direct liability for damage, which employees, members of a statutory body or other assistants cause to a third person while discharging their obligations to their employer or exercising their function in such a body.
