Abstract
The publication deals in detail with the legal regulation of the procedure of taking and further holding of a patient without his consent in a psychiatric institution, from the perspective of current legislation, case law of the European Court of Human Rights, international law and recommendations of international bodies. The analysis also includes several recommendations for government departments or others to ensure effective protection of patients from unjustified interference with their right to personal liberty or other rights.
