Problematic aspects of determining damage and its amount in criminal proceedings

Abstract

The paper discusses selected problems of damage assessment in criminal law. It deals with its connections with non-property damage, unjust enrichment, loss, damage and loss of opportunity (chance, hope).

Furthermore, the contribution identifies the essence of the concept of damage in some special cases, namely damage to property, the connection between the amount of damage and taxes, damage caused on the Internet, damage caused to creditors by so-called bankruptcy crimes, damage in connection with the violation of rules when providing a subsidy, damage caused by the purchase of unnecessary goods and services, damage in the management of municipal property and damage caused by misrepresentation of data on the state of management and assets.
