Judicial Philosophy and Its Influence on judicial decision-making in hard cases : Case study of the Grand Chamber of Czech Supreme Administrative Court

Abstract

The book analyses the influence of judicial philosophy on the judicial decision-making in hard cases. It shows that different appreciation of interpretation metdos, the role of the judiciary and the judicial function determines the judicial method and distinguishes between legal formalists, legal pragmatists and legal substantialists.

The author examines the manifestations of judicial philosophies using a case study of the Grand Chamber of the Czech Supreme Administrative Court.
