Abstract

This contribution attends to the topic of disciplinary offenses of members of Chamber of deputies and senators and related proceedings, which is a very current topic. The current relevance is, due to author's opinion, based on two main reasons.

Firstly, in recent years there has been a gradual decline of political culture, not only in the Czech environment, which leads to the fact that deputies and senators in their speeches, made in the Parliament of the Czech Republic, increasingly use verbal or non-verbal means of communication, which a few years ago would have were either unthinkable or completely unique. As a result of the above, objectively there is an increase in the reasons capable of causing the initiation of much more disciplinary proceedings than was the case in the past.

Secondly, the author sees growing tendencies towards the possible purposeful application of provisions on disciplinary punishment, which could lead to the abuse of this institution. For the stated reasons, according to the author, it is important that legal theory addresses selected issues of this specific type of disciplinary punishment and that problem areas and questions that may arise as a result of somewhat brief legal regulation, be named.

Therefore, from the point of view of the topic addressed, the author has chosen six problematic areas (issues) of valid and effective legal regulations, which he subjects to a critical analysis, and subsequently reflects on possible changes to the legal order.
