Abstract
The contribution deals with the issue of ex officio control of unfair contract terms by courts, which follows from Council Directive 93/13/EEC of 5 April 1993 on unfair contract terms in consumer contracts and from the decision-making practice of the European Court of Justice.
The author deals with the issue of the court's procedure in civil proceedings during the appli- cation of the unfairness test, especially with regard to consequences.
