Skiing before the court - The right of way of the downhill skier is not absolute in Italy

Abstract

The article describes and compares two cases of ski collisions from the point of view of the FIS Rules and in the light of Italian jurisprudence, where one is assessed by default, while in the other the court takes into account the dangerous behavior of the skier riding below, who caused an accident to the skier riding above him with his unexpected maneuver, which caused the collision cannot prevent even when due care is exercised.
