Liability of the heir for the debts of the testator - Czech experience after 10 years from the enactment of the Civil Code

Abstract

The study analyses the recent law regulation of the responsibility of the heirs for the debts (transfer of the debts to heirs ant its scope) made by new Civil Code (2012). This regulation effort aims to balance the protection of the heir and the creditors.

The study to argue with those opinions who support to limit the responsibility of the heirs.
