Abstract

The article deals with the question whether the institute of undisputed facts (identical allegations of the parties) can be used in administrative proceedings. This institute is being introduced into contentious civil proceedings and criminal proceedings with the aim of limiting the scope and subject matter of procedural evidence and thus speeding up, simplifying and streamlining the proceedings.

The article is based on the characteristics of the institute of undisputed facts (identical allegations) and on the comparison of civil and criminal proceedings on the one hand and administrative proceedings on the other hand and concludes that the use of this institute senso strictu in general administrative proceedings cannot be considered. The exceptions are contentious administrative proceedings and proceedings for the determination of a legal relationship under the Administrative Procedure Code.
