The aim of this article is to show the ongoing development of the regulation of employers' liability for damage to employees caused by an accident at work or an occupational disease. Czech legislation does not know accident insurance, so it has to deal with an appropriate design of accident prevention and co-responsibility of the employee for his health and raising the means for his livelihood in a specific legal environment where full compensation is guaranteed with very limited legal possibilities for the employer to evade the obligation to compensate.

At the same time, this system supports litigiousness, as compensation usually has to be decided by a court. The pandemic will thus test the feasibility of the Czech solution, which favours full compensation for the damage caused, but only for those who are not afraid of lengthy court proceedings.
