CRIMINAL LAW PROTECTION OF PRIVACY AND PERSONALITY IN THE ERA OF MODERN TECHNOLOGIES

Abstract

The paper presents a comparative analysis of criminal law protection of privacy and the intimate sphere of an individual against attacks by espionage technology. The first part is devoted to the analysis of the facts found in Swiss and German legislation.

This is followed by the consideration of whether actions that are criminalized in Switzerland and Germany can be subsumed under the facts that can be found in the Czech and Slovak legal system. The author notes the absence of complete criminal law protection.

De lege ferenda recommends the introduction of facts that will provide comprehensive protection of privacy against unauthorized interference by espionage technology.
