Abstract
Although hunting grounds are only made up of hunting grounds, there are also non-hunting grounds very often in their vicinity. Act No. 449/2001 Coll., on hunting (hereafter ZoM) divides land precisely into hunting and non-hunting land in such a way that it determines an exhaustive list of non-hunting land and subsequently designates all others as hunting land (cf. § 17, paragraph 2, § 2 , letter e), § 2, letter f) ZoM).
Nevertheless, practice has brought up a question concerning precisely orchards, gardens and nurseries in connection with (absent) fencing.
