Electronization of Justice and New Technologies in Civil Procedure

Abstract

The chapter in the legal monograph entitled Civil Law and New Technologies focuses on the impact of new technologies on civil procedure. On closer analysis, it is possible to find the specific influence of the advent of modern technology on individual procedural institutes.

These include in particular the areas of electronic deliveries, the maintenance of electronic court files, the use of videoconferencing equipment, the recording of the proceedings by electronic means, or the area of proof and fact-finding in general, or the possibility of automated decision-making. The author concludes by answering the question whether the current state of the law is adequate in relation to technical progress.
