Current and planned changes in czech tourism legislation

Abstract

The purpose of the article is to provide an overview of the Czech legal regulation of tourism, which also serves as an introduction for a special issue dedicated to law of the journal Studia Turistica. Legal regulation of tourism is particularly complicated, in addition it is currently undergoing a fundamental transformation.

The regulation of tourism overlaps mainly with commercial, civil and administrative law and it is significantly influenced by the European Union law. The article deals with various elements of tourism regulation, their legal status in 2020 and the effects of the coronavirus pandemic.

Unfortunately, it is clear that tourism legislation tends to change often and threateningly, as it does today. At the same time, it is very new in the Czech Republic as a whole and was mostly established around the turn of the millennium.

There are complicated, very diverse influences, such as the efforts of the Ministry of Regional Development to improve legislation, the requirements of the European Union for legislation, the real development of the economy and technology, and the instability of Czech law. Although this instability in tourism legislation is likely to improve slightly compared to the current hard crisis.

But the causes usually persist and thus instability too
