The basis for the legal regulation of insolvency proceedings in the Federal Republic of Germany is the Insolvency Code (Insolvenzordnung) of 5 October 1994 (BGBl. I S. 2866), as amended (InsO), which entered into force on 1 January 1999.
The purpose of this article is to search for the specifics of the German legislation in relation to the insolvency administrator and to recommend differences that could be considered as a model solution for the Czech legislation in the future.
