Justice as a norm

Abstract

This paper deals with the concept of justice. It follows the notion of František Weyr, according to whom a justice is a norm.

Since this notion is only a formal one, and according to it everything can be just, it is enriched by the analysis of the concept of legal norm by Pavel Holländer. According to him, a key component of a legal norm is that it pursues a reproduction of life.

From that the paper follows that if justice is a norm, then it must be a norm that is pursuing life and reproduction of it. Therefore, justice is no longer everything, but it has some positive content.

The final part of this paper suggests that such notion leads us to a global thinking about justice, i.e., to some notion of global justice.
