Abstract
The paper deals with the upcoming re-codification of the criminal procedure code in the Czech Republic, with a focus on the significant changes proposed as part of the preliminary hearing. He points to the questionable institutes of the upcoming legislation, which, on the one hand, are intended to simplify the procedure and speed up the activities of law enforcement authorities, but on the other hand, significantly affect the guarantees of a fair trial and the possibility of exercising the procedural rights of the accused.
The authors emphasize the requirement of the legality of criminal proceedings and its compliance with the constitutional guarantees that are provided to the accused in criminal proceedings.
