The Internal Borders of the Schengen Area in Times of Crisis and Reform

Abstract

This paper focuses on the issue of the reintroduction of internal Schengen border controls. After an analysis of the existing Schengen Borders Code and the recent practice of the Member States, attention is being be paid to the relevant case law of the CJEU, which narrows the Member States' margin of discretion at internal borders quite considerably.

The final part of the article is devoted to the perspectives of the reform of the Schengen Borders Code, with particular focus on the use of new technologies instead of the reintroduction of traditional internal border controls.
