First Czech Climate Lawsuit: Difficulties in Deriving the Czech Republic's Climate Change Commitments and the Climate Dimension of the Human Right to a Favourable Environment

Abstract

The first climate proceedings in the Czech Republic were recently decided in which an association sued the state for a lack of measures to reduce greenhouse gas emissions (mitigation). The court of first instance ruled in favor of the plaintiffs in the climate protection case.

However, the Supreme Administrative Court rejected this and referred the case back for a new hearing and decision. This article summarizes the content of the complaint and explains the reasoning of the court of first instance and the Supreme Administrative Court.
