SANCTIONS OR COUNTERMEASURES: AN INTERNATIONAL LAW PERSPECTIVE

Abstract

The word "sanctions" is used today more than ever in the media, in political statements and in legal discourse. In addition to the very widely used term 'sanctions', the term 'restrictive measures' appears above all in European Union documents.

In the terminology of international law, it is mainly the term 'countermeasures' (in terms of general, customary law, as the modern equivalent of peaceful repression), i.e. individual coercive measures, or 'security measures', a term used in some treaties. Often these terms are used promiscuously, contributing to conceptual confusion.
