Abstract

Digital legal transactions raise a number of issues that have not yet been adequately addressed, even where there is no need to comply with the requirements of the written form. The rules concerning compliance with the written form deserve a teleological interpretation based on the functions of the non-digital signature.

De lege ferenda, it is appropriate to consider new, truly digital, qualified forms of legal actions not ideologically linked to the pre-digital world.
