Extreme emergency as an axiological problem

Abstract

The paper presents the institution of extreme emergency from an axiological perspective. Criminal law itself is axiological in nature.

This is doubly true for extreme emergency, since the consideration of the various values protected by criminal law is at its heart. By its nature, however, it cannot be a mechanical consideration.

A fair assessment of cases of conduct in extreme (emergency) situations requires not only a precise knowledge of the applicable legislation and the ability to discern all the relevant circumstances of the case, but also a relatively high degree of empathy. Moreover, in cases of extreme emergency, the most important human values, such as life and health, are often at stake.
