European Union and Boundary Stones: When State Borders Do Not Correspond to Effective Control of Territory

Abstract

The article analyzes the European Union's approach to the territories of the Member States or associated states, whose legal regime is controversial due to the absence of de facto governmental control or due to conflicts with the rules of international law. Using case studies of Cyprus, Germany before 1990, Morocco and Israel, the article maps case law of the Court of Justice of the EU concerning primarily the mobility of persons, the free movement of goods and labelling of products.
