Where is the Criminal Law of the European Union Going (Balance and Perspective)?

Abstract

The fundamental question of the topic is whether there is a criminal law of the European Union at all. Formally, the Treaty on the Functioning of the European Union defines the scope for convergence of criminal law in the section on the area of freedom, security and justice.

This area belongs to the competences shared between the Member States and the European Union. I believe that its implementation has not yet achieved a coherent dimension of EU criminal law, but that it is a process of Europeanisation of criminal law within and between the Member States.
