The European Court of Human Rights and the Venice Commission

Abstract

This paper focuses on the relation between the ECtHR and the Venice Commission, two bodies within one international organization, the Council of Europe. The goal of this paper is to describe how these two institutions are linked together and on which levels.

Their activity is also closely connected with the European Convention on Human Rights. ECtHR and the Venice Commission have a lot features in common, they both focus on protection of human rights; however, they also differ in many respects.

This paper will explain the relation between the named bodies and will try to answer the question whether they complement each other to make the human rights protection system of Council of Europe more comprehensive or not. Second part of this paper focuses on interaction and cooperation between the Court and the Commission, especially on the amicus curiae briefs.
