Access to justice in environmental matters in the EU under the revised Aarhus Regulation

Abstract

The Aarhus Regulation (No 1367/2006), a key legal instrument of the European Union (EU), has long been regarded as a crucial mechanism for promoting transparency, public participation, and access to justice in environmental matters. In 2021, a significant amendment was introduced to this regulation, aiming especially to reinforce access to justice in environmental decision-making.

This presentation critically examines the impact of the 2021 amendment to the Aarhus Regulation on advancing the public interest in environmental protection in the EU. The analysis considers the extent to which the amendment fosters greater access to justice in environmental matters.

It examines the opportunities for the public to access justice and seek remedies in cases of non-compliance with environmental law. It also addresses the potential challenges related to the revised Aarhus Regulation
