Abstract
This paper discusses the possibility of a cheated spouse to seek reimbursement for the costs of a private detective hired in connection with suspected infidelity. The intention is also to answer questions about the legal consequences of infidelity.
The paper also analyses the Austrian case law on this issue. The author stimulates a discussion on the consequences of breaches of family law obligations and emphasises that these obligations should not be merely declaratory.
