Are private school students or their parents protected as consumers?

Abstract

The article deals with the issue whether a contract between a private school and a student (or parents) can be considered a consumer contract. Despite some court decisions, the author argues that students and their parents should be considered consumers and should be protected by consumer law.

The author also discusses the influence of the case law of the Supreme Court of the Czech Republic and the CJEU on this issue.
