Abstract
The subject of this article is an analysis of the obligation of a business corporation to apply environmental, social and corporate governance (hereinafter only "ESG") criteria when awarding public contracts according to Act No. 134/2016 Coll., on Public Procurement, as amended. This analysis is focused on the definition of the legal basis of the stated obligation of the contracting authority, the conditions for application of ESG criteria in the process of public procurement and specific manifestations of ESG in the awarding process.
