Abstract

This paper is a commentary on the provisions of sections 775 to 793 of the Civil Code, which are provisions dealing with the determination of parentage. In relation to the individual provisions, the text therefore contains an interpretation of the determination and denial of maternity and the determination and denial of paternity.

Attention is also paid to related issues such as the difference between legal, biological and genetic parenthood, assisted reproduction and its implications for the legal regulation of the determination of parenthood, surrogacy and the issue of baby-boxes. In the context of the forgiveness of time periods for denying paternity, attention is also paid to the interpretation of the concepts of the best interests of the child and public order and their interrelation.
