Abstract

Given that the creation of a trust creates separate and independent ownership of the property appropriated to a particular purpose and the founder ceases to be the owner of the property, he cannot exercise ownership rights over the property in the trust and cannot change its by-laws in any way. A trust fund is not a legal person and is certainly not a foundation.

It is therefore not possible, by analogy of the law, to apply any of the provisions of this other regulation (legal persons).
