Criminal law and some of its private law contexts

Abstract

This paper deals with some private law contexts of criminal law, which is a representative of public law. The author reflects on the principle of subsidiarity of criminal repression, the protective function of criminal law (the issue of the interest protected by criminal law), the consent of the victim, the position of the victim in criminal proceedings, including his/her possibility to be a subject of the so-called adhesion proceedings and the possibility to influence the criminal prosecution (criminal prosecution with the consent of the victim).

The last institution dealt with is the plea bargain.
