Abstract
The paper deals with the consideration of the possibility of overturning a final decision due to a jurisprudential departure, which stems from the analysis of several decisions of the Supreme Court of the Czech Republic. At the same time, it outlines a possible de lege ferenda approach to the problem of legal defects caused by the subsequently overturned case law.
