Is the Current Regulation of the Complaint in the Criminal Procedure Code Sufficient?

Abstract

The article uses a model example to show that a person affected by a decision of a public authority to seize his or her property has a better procedural position if the seizure of the property occurs in civil proceedings rather than criminal proceedings. The question is whether such a situation is constitutional, fair and just, and whether it would be desirable to change the regulation of the complaint in the Criminal Procedure Code.
