Division of a Profit from a Crime and Criminal Liability for Money Laundering

Abstract

This paper addresses the question of whether the value of individual items that are profit of a single crime can be subsumed under "item of value". The question is important, since the value of the item that is the subject of the legalization is a qualified element of a crime and, in the case of negligent legalization, even a mandatory element.

Existing case law and doctrine rejects the counting of the value of things, while recent commentary literature, without argumentation, opts for a completely different interpretation.
