The European Court of Justice: The adequacy of compensation for expropriation

Abstract

The author informs about the case, which disrupts the balance between public interest and guarantees protection of property, provided that compensation is reasonable in relation to market value at the time of the expropriation of property acquired in good faith occurred. Expert opinion determines the price at the time of the expropriation and not reflecting the current market value of the property can not constitute a decisive basis for determining the amount of compensation for expropriation.
